Brubakers have applied to Louth County Council for planning permission to retain their smoking area on the first floor of the venue at 39 Park Street.
The matter has been rumbling on since late 2013 when owners Peaken Properties Ltd lodged An Bord Pleanala appeal against Dundalk Town Council’s decision to grant them permission to retain it, subject to six conditions.
The local authority claimed at the time that there had been an increase in floor space for the smoking area, which would have meant an increase in rates being paid. However, Declan and Bernie Muckian of Peaken Properties said that an existing office space was converted to form an addition to the small smoking area that was already there.
The council are due to decide on the matter by May 26th.
